Terms of Use

These Terms and Conditions (the "Terms") form a binding agreement between you and AUTISM 911 HELPLINE, CORP., a Florida nonprofit corporation ("Autism 911," "we," "us," or "our"), governing your access to and use of the Autism 911 HelpLine mobile application (the "App").

By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App and delete it from your device.

1. What the App does

The App provides informational, educational, and referral resources for families, caregivers, and individuals affected by autism spectrum disorder, including general guidance about services, insurance and eligibility processes, and connection to providers and community resources.

2. No medical advice or professional relationship

The App does not provide medical, psychological, behavioral, diagnostic, legal, or insurance advice. Content made available through the App is general in nature and is not a substitute for evaluation, diagnosis, or treatment by a qualified health care professional.

Use of the App does not create a doctor–patient, therapist–client, or other professional relationship between you and Autism 911. Always seek the advice of a qualified provider with any questions regarding a medical or behavioral condition. Never disregard professional advice or delay seeking it because of something you read or received through the App.

3. No guarantee of services, coverage, or outcomes

Information about providers, insurers, Medicaid, eligibility, or authorizations is provided for convenience and may change without notice. Autism 911 does not guarantee the availability, quality, licensure, or suitability of any third-party provider, nor does it guarantee that any service will be approved, covered, reimbursed, or delivered. Decisions about coverage and treatment rest with the relevant insurer, agency, and treating professionals.

4. Eligibility and accounts

• You must be at least 18 years of age and legally able to enter into these Terms.
• If you use the App on behalf of a minor or another individual, you represent that you are that person's parent, legal guardian, or authorized representative.
• You agree to provide accurate information and to keep your account credentials confidential. You are responsible for all activity under your account.
• Notify us immediately at contact@autism911helpline.org if you suspect unauthorized use of your account.

5. Acceptable use

You agree not to:

• Use the App for any unlawful, harmful, fraudulent, or abusive purpose.
• Submit information that is false, misleading, or that you are not authorized to share.
• Attempt to access another user's account or any data you are not authorized to access.
• Interfere with, disrupt, probe, or attempt to circumvent the security of the App or its systems.
• Reverse engineer, decompile, disassemble, copy, modify, or create derivative works from the App, except to the extent that applicable law expressly permits it.
• Use automated means to scrape, harvest, or extract data from the App.
• Upload malicious code or any content that infringes the rights of others.

We may suspend or terminate access for conduct that violates these Terms.

6. Privacy and health information

Our handling of information is described in our Privacy Policy, which is incorporated into these Terms by reference. Where Autism 911 handles Protected Health Information subject to HIPAA, that information is also governed by our Notice of Privacy Practices.

Do not transmit sensitive health information through unsecured channels. Communications sent through general-purpose email or messaging are not guaranteed to be secure.

7. Intellectual property

The App, including its software, design, text, graphics, logos, and content, is owned by Autism 911 or its licensors and is protected by United States and international intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial purposes. No other rights are granted.

"Autism 911," "Autism 911 HelpLine," and associated logos are marks of Autism 911 and may not be used without our prior written permission.

8. Third-party services and links

The App may reference or link to third-party websites, providers, insurers, or services. Those third parties are independent of Autism 911. We do not endorse, control, or assume responsibility for their content, practices, availability, or the services they provide. Your dealings with any third party are solely between you and that party.

9. Availability and changes

We may modify, suspend, or discontinue the App or any feature at any time, with or without notice. We do not warrant that the App will be uninterrupted, timely, error-free, or free of viruses or other harmful components. You are responsible for maintaining a compatible device, operating system, and internet connection.

10. Disclaimer of warranties

THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, AUTISM 911 DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AUTISM 911 AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

12. Indemnification

You agree to indemnify, defend, and hold harmless Autism 911 and its directors, officers, employees, volunteers, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of another person or entity.

13. Termination

You may stop using the App at any time and delete your account from within the App or by contacting us. We may suspend or terminate your access at any time if we believe you have violated these Terms or if we discontinue the App. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

14. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any action or proceeding arising out of or relating to these Terms or the App shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

15. Apple App Store terms

The following applies to the App obtained through the Apple App Store:

• These Terms are concluded between you and Autism 911 only, and not with Apple Inc. ("Apple"). Autism 911, not Apple, is solely responsible for the App and its content.
• Apple has no obligation to furnish any maintenance or support services for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Autism 911, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
• Autism 911, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim relating to the App.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where the changes are material, provide notice through the App or by email. Your continued use of the App after an update constitutes acceptance of the revised Terms.

17. Miscellaneous

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Autism 911 regarding the App. If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, consolidation, or transfer of assets.

Estos Términos y Condiciones (los "Términos") constituyen un acuerdo vinculante entre usted y AUTISM 911 HELPLINE, CORP., una corporación sin fines de lucro de Florida ("Autism 911", "nosotros" o "nuestro"), que rige su acceso y uso de la aplicación móvil Autism 911 HelpLine (la "Aplicación").

Al descargar, instalar, acceder o utilizar la Aplicación, usted acepta estos Términos. Si no está de acuerdo, no utilice la Aplicación y elimínela de su dispositivo.

1. Qué hace la Aplicación

La Aplicación ofrece recursos informativos, educativos y de referencia para familias, cuidadores y personas afectadas por el trastorno del espectro autista, incluyendo orientación general sobre servicios, procesos de seguro y elegibilidad, y conexión con proveedores y recursos comunitarios.

2. No constituye asesoramiento médico ni relación profesional

La Aplicación no brinda asesoramiento médico, psicológico, conductual, diagnóstico, legal ni de seguros. El contenido disponible en la Aplicación es de carácter general y no sustituye la evaluación, el diagnóstico ni el tratamiento por parte de un profesional de la salud calificado.

El uso de la Aplicación no crea una relación médico-paciente, terapeuta-cliente ni ninguna otra relación profesional entre usted y Autism 911. Consulte siempre a un profesional calificado ante cualquier duda sobre una condición médica o conductual. Nunca ignore ni demore la búsqueda de consejo profesional por algo que haya leído o recibido a través de la Aplicación.

3. Sin garantía de servicios, cobertura ni resultados

La información sobre proveedores, aseguradoras, Medicaid, elegibilidad o autorizaciones se ofrece por conveniencia y puede cambiar sin previo aviso. Autism 911 no garantiza la disponibilidad, calidad, licencia ni idoneidad de ningún proveedor externo, ni garantiza que un servicio sea aprobado, cubierto, reembolsado o prestado. Las decisiones sobre cobertura y tratamiento corresponden a la aseguradora, la agencia y los profesionales tratantes.

4. Elegibilidad y cuentas

• Debe tener al menos 18 años y capacidad legal para aceptar estos Términos.
• Si utiliza la Aplicación en nombre de un menor o de otra persona, declara ser su padre, madre, tutor legal o representante autorizado.
• Se compromete a proporcionar información veraz y a mantener la confidencialidad de sus credenciales. Usted es responsable de toda actividad realizada bajo su cuenta.
• Notifíquenos de inmediato a contact@autism911helpline.org si sospecha un uso no autorizado de su cuenta.

5. Uso aceptable

Usted se compromete a no:

• Utilizar la Aplicación con fines ilícitos, dañinos, fraudulentos o abusivos.
• Enviar información falsa, engañosa o que no esté autorizado a compartir.
• Intentar acceder a la cuenta de otro usuario o a datos para los que no tenga autorización.
• Interferir, alterar, sondear o intentar eludir la seguridad de la Aplicación o de sus sistemas.
• Realizar ingeniería inversa, descompilar, desensamblar, copiar, modificar o crear obras derivadas de la Aplicación, salvo en la medida en que la ley aplicable lo permita expresamente.
• Emplear medios automatizados para extraer o recopilar datos de la Aplicación.
• Cargar código malicioso o contenido que vulnere derechos de terceros.

Podremos suspender o cancelar el acceso ante conductas que infrinjan estos Términos.

6. Privacidad e información de salud

El tratamiento de la información se describe en nuestra Política de Privacidad, que se incorpora a estos Términos por referencia. Cuando Autism 911 maneje Información Médica Protegida sujeta a HIPAA, dicha información también se rige por nuestro Aviso de Prácticas de Privacidad.

No transmita información de salud sensible por canales no seguros. No se garantiza la seguridad de las comunicaciones enviadas por correo electrónico o mensajería de uso general.

7. Propiedad intelectual

La Aplicación, incluidos su software, diseño, textos, gráficos, logotipos y contenido, es propiedad de Autism 911 o de sus licenciantes y está protegida por las leyes de propiedad intelectual de Estados Unidos e internacionales. Sujeto a estos Términos, le otorgamos una licencia limitada, personal, no exclusiva, intransferible y revocable para usar la Aplicación con fines propios y no comerciales. No se conceden otros derechos.

"Autism 911", "Autism 911 HelpLine" y los logotipos asociados son marcas de Autism 911 y no pueden utilizarse sin nuestro consentimiento previo por escrito.

8. Servicios y enlaces de terceros

La Aplicación puede hacer referencia o enlazar a sitios web, proveedores, aseguradoras o servicios de terceros. Dichos terceros son independientes de Autism 911. No los respaldamos ni controlamos, ni asumimos responsabilidad por su contenido, prácticas, disponibilidad o los servicios que prestan. Sus tratos con cualquier tercero son exclusivamente entre usted y ese tercero.

9. Disponibilidad y cambios

Podemos modificar, suspender o descontinuar la Aplicación o cualquiera de sus funciones en cualquier momento, con o sin previo aviso. No garantizamos que la Aplicación sea ininterrumpida, oportuna, libre de errores ni libre de virus u otros componentes dañinos. Usted es responsable de contar con un dispositivo, sistema operativo y conexión a internet compatibles.

10. Exención de garantías

LA APLICACIÓN Y TODO SU CONTENIDO SE PROPORCIONAN "TAL CUAL" Y "SEGÚN DISPONIBILIDAD", SIN GARANTÍAS DE NINGÚN TIPO, YA SEAN EXPRESAS, IMPLÍCITAS O LEGALES. EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY, AUTISM 911 RECHAZA TODA GARANTÍA, INCLUIDAS LAS GARANTÍAS IMPLÍCITAS DE COMERCIABILIDAD, IDONEIDAD PARA UN FIN DETERMINADO, TITULARIDAD, EXACTITUD Y NO INFRACCIÓN. ALGUNAS JURISDICCIONES NO PERMITEN LA EXCLUSIÓN DE CIERTAS GARANTÍAS, POR LO QUE ALGUNAS DE ESTAS EXCLUSIONES PODRÍAN NO APLICARLE.

11. Limitación de responsabilidad

EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY, AUTISM 911 Y SUS DIRECTORES, FUNCIONARIOS, EMPLEADOS, VOLUNTARIOS Y AGENTES NO SERÁN RESPONSABLES POR DAÑOS INDIRECTOS, INCIDENTALES, ESPECIALES, CONSECUENTES, EJEMPLARES O PUNITIVOS, NI POR PÉRDIDA DE DATOS, REPUTACIÓN O BENEFICIOS, DERIVADOS DE O RELACIONADOS CON EL USO O LA IMPOSIBILIDAD DE USO DE LA APLICACIÓN, INCLUSO SI SE ADVIRTIÓ DE LA POSIBILIDAD DE TALES DAÑOS.

NUESTRA RESPONSABILIDAD TOTAL AGREGADA DERIVADA DE O RELACIONADA CON ESTOS TÉRMINOS O LA APLICACIÓN NO EXCEDERÁ LOS CIEN DÓLARES ESTADOUNIDENSES (US$100). NADA EN ESTOS TÉRMINOS EXCLUYE NI LIMITA RESPONSABILIDADES QUE NO PUEDAN LIMITARSE LEGALMENTE.

12. Indemnización

Usted acepta indemnizar, defender y eximir de responsabilidad a Autism 911 y a sus directores, funcionarios, empleados, voluntarios y agentes frente a cualquier reclamación, responsabilidad, daño, pérdida y gasto, incluidos honorarios razonables de abogados, derivados de o relacionados con su uso de la Aplicación, su incumplimiento de estos Términos o la vulneración de derechos de otra persona o entidad.

13. Terminación

Usted puede dejar de usar la Aplicación en cualquier momento y eliminar su cuenta desde la propia Aplicación o contactándonos. Podremos suspender o cancelar su acceso en cualquier momento si consideramos que ha incumplido estos Términos o si descontinuamos la Aplicación. Las secciones que por su naturaleza deban subsistir tras la terminación — incluidas propiedad intelectual, exenciones, limitación de responsabilidad, indemnización y ley aplicable — permanecerán vigentes.

14. Ley aplicable y jurisdicción

Estos Términos se rigen por las leyes del Estado de Florida, sin atender a sus normas sobre conflicto de leyes. Toda acción o procedimiento derivado de o relacionado con estos Términos o la Aplicación se presentará exclusivamente ante los tribunales estatales o federales ubicados en el Condado de Miami-Dade, Florida, y usted consiente la jurisdicción personal de dichos tribunales.

15. Condiciones de la App Store de Apple

Lo siguiente aplica a la Aplicación obtenida a través de la App Store de Apple:

• Estos Términos se celebran únicamente entre usted y Autism 911, y no con Apple Inc. ("Apple"). Autism 911, y no Apple, es el único responsable de la Aplicación y de su contenido.
• Apple no tiene obligación alguna de prestar servicios de mantenimiento o soporte respecto de la Aplicación.
• Si la Aplicación no cumple con alguna garantía aplicable, usted puede notificarlo a Apple, y Apple podrá reembolsar el precio de compra, si lo hubiera. En la máxima medida permitida por la ley, Apple no tendrá ninguna otra obligación de garantía respecto de la Aplicación.
• Autism 911, y no Apple, es responsable de atender cualquier reclamación relativa a la Aplicación, incluidas reclamaciones por responsabilidad del producto, por incumplimiento de requisitos legales o regulatorios, y las derivadas de normas de protección al consumidor o similares.

16. Cambios a estos Términos

Podemos actualizar estos Términos periódicamente. Cuando lo hagamos, modificaremos la fecha de "Última actualización" indicada arriba y, cuando los cambios sean sustanciales, lo notificaremos a través de la Aplicación o por correo electrónico. El uso continuado de la Aplicación tras una actualización constituye la aceptación de los Términos revisados.

17. Disposiciones generales

Estos Términos, junto con la Política de Privacidad, constituyen el acuerdo íntegro entre usted y Autism 911 respecto de la Aplicación. Si alguna disposición se considera inexigible, las restantes permanecerán en pleno vigor. La falta de exigencia de cualquier disposición no constituye renuncia a la misma. Usted no puede ceder estos Términos sin nuestro consentimiento previo por escrito; nosotros podemos cederlos en relación con una fusión, consolidación o transferencia de activos.

By accessing or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Authorized access

• Access is granted only to individuals authorized by Autism 911 in connection with a current employment, contractor, volunteer, or affiliation relationship.
• You must be at least 18 years of age and legally able to enter into these Terms.
• You must hold and maintain any license, certification, registration, or credential required for your role under applicable law, and must notify Autism 911 promptly of any lapse, restriction, suspension, or revocation.
• Your access terminates automatically when your relationship with Autism 911 ends.

2. Account security

• Your credentials are personal and non-transferable. Never share your username, password, or authentication factors with anyone, including colleagues and supervisors.
• Keep your device protected with a passcode or biometric lock and current operating system updates.
• You are responsible for all activity conducted under your account.
• Report any suspected compromise, lost or stolen device, or unauthorized access immediately to contact@autism911helpline.org.

3. Confidentiality and HIPAA obligations

The App may provide access to confidential information, including Protected Health Information ("PHI") governed by the Health Insurance Portability and Accountability Act of 1996 and its implementing regulations ("HIPAA"). As a condition of access, you agree that you will:

• Access only the minimum information necessary to perform your assigned role, and only for individuals assigned to you.
• Use and disclose PHI only as permitted by HIPAA, by applicable Florida law, by our Notice of Privacy Practices, and by Autism 911's internal policies.
• Not take screenshots or screen recordings of PHI, and not copy, export, print, forward, or store PHI outside approved systems — including personal email, personal cloud storage, messaging applications, or personal devices not authorized by Autism 911.
• Not discuss or display PHI in public places or where it may be overheard or seen by unauthorized persons.
• Report any actual or suspected privacy or security incident, including the loss or theft of a device, without delay.
• Return or destroy all confidential information in your possession when your access ends.

Your activity within the App is logged and subject to audit. Unauthorized access or disclosure may result in immediate termination of access and in disciplinary, contractual, civil, or criminal consequences under federal and state law.

These obligations survive the termination of your access and of any relationship with Autism 911.

4. Accuracy of information you enter

You are responsible for the accuracy, completeness, and timeliness of any information, documentation, note, or record you enter, upload, or submit through the App. Entries may form part of a clinical, administrative, or billing record. You must not enter information that is false, falsified, backdated, or that you are not authorized to record.

5. Professional responsibility

The App is a tool that supports your work. It does not replace your professional judgment, your supervisory obligations, or the standards of practice and ethical rules applicable to your profession and license. Nothing in the App constitutes clinical, legal, or billing advice, and you remain solely responsible for the decisions you make and the services you deliver.

6. Acceptable use

You agree not to:

• Use the App for any unlawful, fraudulent, harassing, or abusive purpose.
• Attempt to access records, accounts, or data you are not authorized to access.
• Circumvent, disable, probe, or test the security, authentication, access controls, or audit functions of the App.
• Reverse engineer, decompile, disassemble, copy, modify, or create derivative works from the App, except to the extent applicable law expressly permits it.
• Use automated means to scrape, harvest, or extract data from the App.
• Introduce malicious code, or use jailbroken or rooted devices, or devices without current security updates.

7. Privacy

Our handling of information is described in our Privacy Policy, which is incorporated into these Terms by reference. Where PHI is involved, our Notice of Privacy Practices also applies. You acknowledge that your use of the App, including sign-in events and records accessed, is recorded in audit logs retained as required by HIPAA.

The App, including its software, design, text, graphics, logos, and content, is owned by Autism 911 or its licensors and is protected by United States and international intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App solely for authorized work purposes during the term of your authorization. No other rights are granted.

9. Third-party services

The App may connect to or reference third-party systems, insurers, clearinghouses, or public resources. Those third parties are independent of Autism 911. We do not control them and are not responsible for their content, availability, or practices.

10. Availability and changes

We may modify, suspend, or discontinue the App or any feature at any time, with or without notice, including for maintenance or security reasons. We do not warrant that the App will be uninterrupted, timely, error-free, or free of harmful components. You are responsible for maintaining a compatible device, operating system, and internet connection. You must not rely on the App as your only record of time-sensitive or clinically significant information; follow your organization's documentation and contingency procedures.

11. Disclaimer of warranties

THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, AUTISM 911 DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AUTISM 911 AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

13. Indemnification

You agree to indemnify, defend, and hold harmless Autism 911 and its directors, officers, employees, volunteers, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the App, your violation of these Terms, your breach of confidentiality or HIPAA obligations, or your violation of any rights of another person or entity.

14. Suspension and termination

We may suspend or terminate your access at any time, with or without notice, including when your relationship with Autism 911 ends, when a credential lapses, when we suspect a security or privacy violation, or when we discontinue the App. Upon termination you must cease all use of the App and delete it from your devices. Sections that by their nature should survive — including confidentiality, HIPAA obligations, intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

15. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any action or proceeding arising out of or relating to these Terms or the App shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

16. Apple App Store terms

The following applies to the App obtained through the Apple App Store:

• These Terms are concluded between you and Autism 911 only, and not with Apple Inc. ("Apple"). Autism 911, not Apple, is solely responsible for the App and its content.
• Apple has no obligation to furnish any maintenance or support services for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Autism 911, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
• Autism 911, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim relating to the App.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.

17. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where the changes are material, provide notice through the App or by email. Continued use of the App after an update constitutes acceptance of the revised Terms.

18. Miscellaneous

These Terms, together with the Privacy Policy and any written agreement between you and Autism 911 regarding your role, constitute the entire agreement regarding the App. Where a separate employment, contractor, or confidentiality agreement imposes stricter obligations, the stricter obligation controls. If any provision is held unenforceable, the remaining provisions remain in full force. You may not assign these Terms.

1. Acceso autorizado

• El acceso se otorga únicamente a personas autorizadas por Autism 911 en relación con una vinculación vigente de empleo, contratación, voluntariado o afiliación.
• Debe tener al menos 18 años y capacidad legal para aceptar estos Términos.
• Debe poseer y mantener vigente toda licencia, certificación, registro o credencial exigida para su función conforme a la ley aplicable, y notificar sin demora a Autism 911 cualquier vencimiento, restricción, suspensión o revocación.
• Su acceso termina automáticamente cuando finaliza su vinculación con Autism 911.

2. Seguridad de la cuenta

• Sus credenciales son personales e intransferibles. Nunca comparta su usuario, contraseña ni factores de autenticación con nadie, incluidos colegas y supervisores.
• Mantenga su dispositivo protegido con código de acceso o bloqueo biométrico y con actualizaciones vigentes del sistema operativo.
• Usted es responsable de toda actividad realizada bajo su cuenta.
• Reporte de inmediato a contact@autism911helpline.org cualquier sospecha de compromiso, pérdida o robo del dispositivo, o acceso no autorizado.

3. Confidencialidad y obligaciones bajo HIPAA

La Aplicación puede dar acceso a información confidencial, incluida Información Médica Protegida ("PHI") regida por la Ley de Portabilidad y Responsabilidad del Seguro Médico de 1996 y sus reglamentos ("HIPAA"). Como condición de acceso, usted se compromete a:

• Acceder únicamente a la información mínima necesaria para desempeñar su función asignada, y solo respecto de las personas que tenga asignadas.
• Usar y divulgar PHI únicamente según lo permitido por HIPAA, por la legislación aplicable de Florida, por nuestro Aviso de Prácticas de Privacidad y por las políticas internas de Autism 911.
• No tomar capturas ni grabaciones de pantalla de PHI, y no copiar, exportar, imprimir, reenviar ni almacenar PHI fuera de los sistemas aprobados — incluidos correo personal, almacenamiento en la nube personal, aplicaciones de mensajería o dispositivos personales no autorizados por Autism 911.
• No comentar ni mostrar PHI en lugares públicos o donde pueda ser escuchada o vista por personas no autorizadas.

Su actividad dentro de la Aplicación queda registrada y sujeta a auditoría. El acceso o la divulgación no autorizados pueden derivar en la cancelación inmediata del acceso y en consecuencias disciplinarias, contractuales, civiles o penales conforme a la legislación federal y estatal.

Estas obligaciones subsisten tras la terminación de su acceso y de cualquier vinculación con Autism 911.

4. Exactitud de la información que registra

Usted es responsable de la exactitud, integridad y oportunidad de toda información, documentación, nota o registro que ingrese, cargue o envíe mediante la Aplicación. Los registros pueden formar parte de un expediente clínico, administrativo o de facturación. No debe ingresar información falsa, falsificada, con fecha alterada, ni que no esté autorizado a registrar.

5. Responsabilidad profesional

La Aplicación es una herramienta de apoyo a su trabajo. No sustituye su juicio profesional, sus obligaciones de supervisión, ni los estándares de práctica y normas éticas aplicables a su profesión y licencia. Nada en la Aplicación constituye asesoramiento clínico, legal ni de facturación, y usted sigue siendo el único responsable de las decisiones que tome y de los servicios que preste.

6. Uso aceptable

Usted se compromete a no:

• Utilizar la Aplicación con fines ilícitos, fraudulentos, de acoso o abusivos.
• Intentar acceder a expedientes, cuentas o datos para los que no tenga autorización.
• Eludir, desactivar, sondear o poner a prueba la seguridad, la autenticación, los controles de acceso o las funciones de auditoría de la Aplicación.
• Realizar ingeniería inversa, descompilar, desensamblar, copiar, modificar o crear obras derivadas de la Aplicación, salvo en la medida en que la ley aplicable lo permita expresamente.
• Emplear medios automatizados para extraer o recopilar datos de la Aplicación.
• Introducir código malicioso, o usar dispositivos con jailbreak o root, o sin actualizaciones de seguridad vigentes.

7. Privacidad

El tratamiento de la información se describe en nuestra Política de Privacidad, que se incorpora a estos Términos por referencia. Cuando se trate de PHI, también aplica nuestro Aviso de Prácticas de Privacidad. Usted reconoce que su uso de la Aplicación, incluidos los inicios de sesión y los registros consultados, queda asentado en registros de auditoría conservados conforme a HIPAA.

8. Propiedad intelectual

La Aplicación, incluidos su software, diseño, textos, gráficos, logotipos y contenido, es propiedad de Autism 911 o de sus licenciantes y está protegida por las leyes de propiedad intelectual de Estados Unidos e internacionales. Sujeto a estos Términos, le otorgamos una licencia limitada, personal, no exclusiva, intransferible y revocable para usar la Aplicación únicamente con fines laborales autorizados durante la vigencia de su autorización. 9. Servicios de terceros

La Aplicación puede conectarse o hacer referencia a sistemas de terceros, aseguradoras, cámaras de compensación o recursos públicos. Dichos terceros son independientes de Autism 911. No los controlamos ni somos responsables de su contenido, disponibilidad o prácticas.

10. Disponibilidad y cambios

Podemos modificar, suspender o descontinuar la Aplicación o cualquiera de sus funciones en cualquier momento, con o sin previo aviso, incluso por razones de mantenimiento o seguridad. No garantizamos que la Aplicación sea ininterrumpida, oportuna, libre de errores ni libre de componentes dañinos. Usted es responsable de contar con un dispositivo, sistema operativo y conexión a internet compatibles. No debe depender de la Aplicación como único registro de información urgente o clínicamente relevante; siga los procedimientos de documentación y contingencia de su organización.

11. Exención de garantías

LA APLICACIÓN Y TODO SU CONTENIDO SE PROPORCIONAN "TAL CUAL" Y "SEGÚN DISPONIBILIDAD", SIN GARANTÍAS DE NINGÚN TIPO, YA SEAN EXPRESAS, IMPLÍCITAS O LEGALES. EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY, AUTISM 911 RECHAZA TODA GARANTÍA, INCLUIDAS LAS GARANTÍAS IMPLÍCITAS DE COMERCIABILIDAD, IDONEIDAD PARA UN FIN DETERMINADO, TITULARIDAD, EXACTITUD Y NO INFRACCIÓN.

12. Limitación de responsabilidad

EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY, AUTISM 911 Y SUS DIRECTORES, FUNCIONARIOS, EMPLEADOS, VOLUNTARIOS Y AGENTES NO SERÁN RESPONSABLES POR DAÑOS INDIRECTOS, INCIDENTALES, ESPECIALES, CONSECUENTES, EJEMPLARES O PUNITIVOS, NI POR PÉRDIDA DE DATOS, REPUTACIÓN O BENEFICIOS, DERIVADOS DE O RELACIONADOS CON EL USO O LA IMPOSIBILIDAD DE USO DE LA APLICACIÓN, INCLUSO SI SE ADVIRTIÓ DE LA POSIBILIDAD DE TALES DAÑOS.

13. Indemnización

Usted acepta indemnizar, defender y eximir de responsabilidad a Autism 911 y a sus directores, funcionarios, empleados, voluntarios y agentes frente a cualquier reclamación, responsabilidad, daño, pérdida y gasto, incluidos honorarios razonables de abogados, derivados de o relacionados con su uso de la Aplicación, su incumplimiento de estos Términos, su incumplimiento de obligaciones de confidencialidad o de HIPAA, o la vulneración de derechos de otra persona o entidad.

14. Suspensión y terminación

Podemos suspender o cancelar su acceso en cualquier momento, con o sin previo aviso, incluso cuando finalice su vinculación con Autism 911, cuando venza una credencial, cuando sospechemos una violación de seguridad o privacidad, o cuando descontinuemos la Aplicación. Al terminar, debe cesar todo uso de la Aplicación y eliminarla de sus dispositivos. Las secciones que por su naturaleza deban subsistir — incluidas confidencialidad, obligaciones bajo HIPAA, propiedad intelectual, exenciones, limitación de responsabilidad, indemnización y ley aplicable — permanecerán vigentes.

15. Ley aplicable y jurisdicción

Estos Términos se rigen por las leyes del Estado de Florida, sin atender a sus normas sobre conflicto de leyes. Toda acción o procedimiento derivado de o relacionado con estos Términos o la Aplicación se presentará exclusivamente ante los tribunales estatales o federales ubicados en el Condado de Miami-Dade, Florida, y usted consiente la jurisdicción personal de dichos tribunales.

16. Condiciones de la App Store de Apple

Lo siguiente aplica a la Aplicación obtenida a través de la App Store de Apple:

• Estos Términos se celebran únicamente entre usted y Autism 911, y no con Apple Inc. ("Apple"). Autism 911, y no Apple, es el único responsable de la Aplicación y de su contenido.
• Apple no tiene obligación alguna de prestar servicios de mantenimiento o soporte respecto de la Aplicación.
• Si la Aplicación no cumple con alguna garantía aplicable, usted puede notificarlo a Apple, y Apple podrá reembolsar el precio de compra, si lo hubiera. En la máxima medida permitida por la ley, Apple no tendrá ninguna otra obligación de garantía respecto de la Aplicación.
• Autism 911, y no Apple, es responsable de atender cualquier reclamación relativa a la Aplicación, incluidas reclamaciones por responsabilidad del producto, por incumplimiento de requisitos legales o regulatorios, y las derivadas de normas de protección al consumidor o similares.

17. Cambios a estos Términos

Podemos actualizar estos Términos periódicamente. Cuando lo hagamos, modificaremos la fecha de "Última actualización" indicada arriba y, cuando los cambios sean sustanciales, lo notificaremos a través de la Aplicación o por correo electrónico. El uso continuado de la Aplicación tras una actualización constituye la aceptación de los Términos revisados.

18. Disposiciones generales

Estos Términos, junto con la Política de Privacidad y cualquier acuerdo escrito entre usted y Autism 911 relativo a su función, constituyen el acuerdo íntegro respecto de la Aplicación. Cuando un contrato separado de empleo, prestación de servicios o confidencialidad imponga obligaciones más estrictas, prevalecerá la obligación más estricta. Si alguna disposición se considera inexigible, las restantes permanecerán en pleno vigor. Usted no puede ceder estos Términos.
